‘THE DRIVING SCHOOL’ ‘Bristol Intensives’ means the driving school administering the provision of the driving course and allocating you to a self-employed subcontractor who is a registered DVSA driving instructor. Bristol Intensives Ltd does not book or manage practical car driving tests on behalf of pupils.

‘THE DRIVING INSTRUCTOR’ means a driving instructor acting on his/her own or on behalf of a driving school when providing the course

Terms & Conditions.

Bristol Intensives will book the appropriate tests and will act as an agent to locate a Driving Instructor to provide you with the driving lessons. After making a booking with Bristol Intensives, you will enter a separate contract for the lessons which is solely between yourself and the Driving Instructor who is self-employed and who is independent from Bristol Intensives. At no time can we guarantee that you will pass the driving test

1. The course includes the time required for taking your practical test and the drive home at the end of the course. You may book more hours (if required) with your instructor at an agreed hourly rate (this can be agreed between you the pupil and your instructor). Also please note: courses are not guaranteed to be completed over one week, larger courses 30 hours or more may be completed over two weeks, subject to instructor availability. Any breaks will also be included at the driving instructor’s discretion.

2. All pupils must meet the legally required eyesight standard for driving, including being able to read a vehicle registration number plate from the distance prescribed by law. The eyesight check will normally be conducted by your Driving Instructor at the beginning of your tuition. If you fail the eyesight check, tuition involving driving cannot continue until you meet the legal eyesight requirements. Charges may apply for instructor time already reserved which cannot reasonably be reallocated.

3. If your Driving Instructor reasonably considers that your driving standard is unsafe for independent assessment, the instructor reserves the right to refuse use of their vehicle for the practical driving test. This does not cancel your DVSA practical test booking. You remain responsible for deciding whether to attend the test using another suitable vehicle which meets DVSA requirements. Any refund relating to unused course hours will be assessed in accordance with these Terms & Conditions, taking into account tuition already provided, costs incurred, instructor time reserved and whether the remaining reserved instructor time can reasonably be reallocated.

4. Course prices do not include the DVSA practical car driving test fee. You are responsible for booking, managing and paying the DVSA directly for your practical driving test. Where Bristol Intensives Ltd agrees to arrange a theory test on your behalf, the applicable charge will be made clear before the theory test is booked. Any theory test or theory retest administration charge quoted by Bristol Intensives Ltd is separate from your practical driving test fee.

5. A deposit (initial part payment) is required to secure your course booking. This deposit forms part of the total course price and reserves instructor time, test booking arrangements, and administration work undertaken by Bristol Intensives. If you cancel after administrative work has begun or instructor time has been reserved, we may retain the deposit to cover costs incurred and loss of reserved instructor availability. Any payments made beyond the deposit may be refundable depending on the notice provided, services already delivered, and whether instructor time can be reallocated.

Cooling-Off Period

Where you enter into a qualifying distance or off-premises contract with Bristol Intensives Ltd, you normally have a statutory right to cancel the contract within 14 days without giving a reason. If you expressly request Bristol Intensives Ltd to begin providing services during the 14-day cancellation period, you agree that Bristol Intensives Ltd may begin providing those services before the cancellation period expires. If you exercise your statutory right to cancel after services have begun at your express request, you may be required to pay an amount proportionate to the services supplied up to the time you notify Bristol Intensives Ltd of your cancellation. Where the service has been fully performed during the cancellation period following your express request to begin the service and your acknowledgement that your cancellation right will be lost once the service has been fully performed, your statutory right to cancel may end when the service has been fully performed. Your statutory cancellation rights are separate from the course cancellation provisions contained in Clauses 6 and 6A.

6. If you wish to cancel your course, you must notify Bristol Intensives Ltd. Where cancellation is received at least 10 working days before the scheduled start date of your first lesson, Bristol Intensives Ltd will refund payments received, less a £50 cancellation and administration charge representing the reasonable administrative costs associated with processing and arranging the booking. Where cancellation is received less than 10 working days before the scheduled start date, Clause 6A applies. For the purposes of these Terms & Conditions, working days are Monday to Friday excluding bank holidays in England and Wales. This clause does not affect statutory cancellation rights which apply to your booking, including any applicable statutory cooling-off period.

6A. Late Cancellation or Cancellation After the Course Has Started

If you cancel your intensive driving course less than 10 working days before the scheduled start date of your first lesson, instructor time will normally already have been specifically reserved and allocated to your course. The same principles apply if you choose to discontinue or cancel your intensive driving course after the course has started for reasons unrelated to any failure by Bristol Intensives Ltd or the allocated Driving Instructor. This includes a change in personal circumstances, deciding not to continue with the course or requesting a change from manual to automatic tuition or from automatic to manual tuition which prevents the originally reserved course from continuing. Bristol Intensives Ltd and/or the allocated Driving Instructor are entitled to retain from payments already made an amount representing the reasonable losses arising directly from your cancellation or discontinuation. These losses may include tuition already provided, administration and booking work already undertaken, reasonable payment processing costs which are not recoverable, instructor time specifically reserved for your course which cannot reasonably be reallocated, and other reasonable direct costs or losses resulting from the cancellation. Where some or all of the reserved instructor time is successfully reallocated to another pupil, this will be taken into account when calculating any refund due. Bristol Intensives Ltd and the Driving Instructor will take reasonable steps to reduce losses arising from cancellation where practicable. Depending on tuition already provided, administration undertaken, instructor time specifically reserved, losses arising from cancellation and the extent to which the reserved instructor time can reasonably be reallocated, the amount retained may be up to the full amount paid where the reasonable losses arising from cancellation equal or exceed the amount paid. Unused lesson hours are not automatically refundable solely because the pupil decides not to complete the course. Any refund due will be calculated after taking into account services already supplied and reasonable losses directly resulting from cancellation or discontinuation. This clause does not affect your statutory rights.

7. Additional lessons booked directly with the Driving Instructor are subject to the Driving Instructor's cancellation policy. The applicable cancellation requirements should be communicated by the Driving Instructor when the additional lessons are arranged. Payment for additional lessons is made directly to the Driving Instructor unless otherwise agreed.

8. When taking a crash driving course it is not normally possible to drive continuously, therefore, short breaks can be arranged between you and your instructor at both parties’ discretion, whenever either of you feels that rest is required.

9. Your intensive driving course includes break times and time to rent / hire the driving instructor’s vehicle for the practical test and drive you home / back to your agreed meeting point at the end of the test.

10. Bristol Intensives Ltd provides booking and course administration services and arranges for driving tuition to be provided by self-employed Driving Instructors. Bristol Intensives Ltd does not itself provide driving tuition. Driving tuition is provided by the allocated Driving Instructor. The Driving Instructor is responsible for the professional delivery of the driving tuition and for decisions concerning the safe use of their tuition vehicle.

11. A ‘successful booking’ is when we allocate an ADI and the Instructor and pupil agree to begin the driving course.

12. All courses are booked and based with advice on average learning capabilities from past client experience and are a rough guide only. No guarantees can be implied by any advisor or instructor. You should be prepared for extra tuition if it is felt that it is required before you are allowed to safely attend the driving test.

13. A practical driving test cannot be booked until the pupil has successfully passed the theory test and we have been informed of the theory pass number.

14. Practical test availability is subject to tests made available by the Driver and Vehicle Standards Agency (DVSA). We will check test availability and confirm test date and time when booking your intensive course with us before taking your deposit

15. The contract of the Crash Course / Intensive Course is between the pupil and the driving instructor. Any disputes or claims should, therefore, be taken up with the instructor firstly and not Bristol Intensives. We cannot be held liable for any compensation claim from a pupil, nor can it be held responsible for any traffic violation on the part of the pupil or the instructor. Bristol Intensives acts as a booking agent and is paid on commission off the instructor for successful bookings.

16. The deposit (initial part payment) for the course is payable on booking a course to Bristol Intensives, which is for booking the appropriate tests in advance, searching and reserving you a local driving instructor and for the ongoing administration required. The deposit is not the full balance and includes payment for administrative services provided by Bristol Intensives in arranging the course.

17. The remaining balance of any course is payable directly to the subcontracted driving instructor who is teaching you and is for the lesson fees. The instructor may request payment several days before the course is due to start to ensure that the pupil is intending to go ahead with the course and will not let the instructor down at the last minute. Failure to pay for the remaining balance when requested may result in course cancellation and retention of the deposit to cover administrative work and reserved instructor time. Should you pay the remaining balance to Bristol Intensives, then we would only be acting as an intermediary and would transfer the money to the allocated instructor you are paying for the driving course.

18. If the Driving Instructor's vehicle becomes unavailable due to breakdown or another unexpected problem, reasonable efforts will be made to rearrange the affected tuition or, where practicable, arrange an alternative instructor or suitable tuition vehicle. Where affected tuition cannot reasonably be rearranged or provided, an appropriate refund will be made for tuition which cannot be supplied. Lessons already provided remain chargeable.

19. Bristol Intensives Ltd and the Driving Instructor are not responsible for losses which arise solely from events outside their reasonable control. Such events may include severe weather, DVSA examiner cancellation, industrial action, road closures or other events which prevent tuition or a practical test from proceeding despite reasonable precautions. Where the Driving Instructor is unable to provide scheduled tuition because of illness, vehicle breakdown or another problem affecting the instructor, reasonable efforts will be made to rearrange the affected tuition. Where tuition cannot reasonably be rearranged or supplied, the pupil will be entitled to an appropriate refund for the tuition which has not been provided. Nothing in this clause removes any statutory remedy available where contracted services are not supplied as agreed.

20. Please do not make any travel or accommodation arrangements if you are not taking the course with a pick up from home, until the course is confirmed directly with your appointed driving instructor.

21. Please do not book time off work until you have spoken to your appointed instructor and discussed and confirmed your schedule.

22. All bookings are a provisional start date until confirmed directly with your driving instructor. Should an instructor be unavailable for your desired start week, we would automatically search for a start the following week until the course is allocated.

23. If the pupil falls ill and cannot continue the course for any reason, we would look to re-organise the course for a time when the pupil is fit and well again. If you fall ill and need to cancel any lessons without at least one week’s notice, these hours may be forfeited unless the instructor states otherwise, or may be subject to charges for reserved instructor time that cannot reasonably be reallocated.

24. Due to the development of Corona Virus, if the instructor has to self-isolate and the course has to be delayed, we will make reasonable efforts to rearrange the course. Where rearrangement is not feasible, any refund will be assessed fairly based on services already provided, costs incurred, and instructor time reserved.

The Course.

1. All courses are undertaken with a DVSA registered self-employed instructor and is on an individual basis.

2. We do not offer shared courses e.g. 2 pupils in the car.

3. No guarantee can be made of test availability, especially if your theory certificate is about to expire (it is valid for 2 years). In the event that a test cannot be booked for the end of the course, then an alternative test will be offered for a date and time agreeable to the pupil and instructor. Any refund request will be assessed fairly based on services already provided, costs incurred, and instructor time reserved. Also, if the DVSA cancels a test for whatever reason, then we cannot be held responsible/liable for the test fee and any lesson time lost, you may need to purchase additional lessons to retake the test. You may be able to claim reimbursement of some lesson time off the DVSA in certain circumstances.

4. Whilst every effort is made to get the pupil to the required level to take the driving test, if it is thought by the instructor that the pupil’s standard of driving falls below the expected standard, then for the health and safety of the pupil, examiner and general public, the pupil will not be allowed to take the test. Any refund request will be assessed fairly based on lessons already delivered, costs incurred, and instructor time reserved.

5. All our instructors have been approved or licensed by the Driving and Vehicle Standards Agency.

6. The car provided by the instructor will be comprehensively insured with a reputable insurer. A pupil can request to see insurance documentation from their instructor at any time. Bristol Intensives Ltd cannot be held responsible for any insurance-related claims. Any disputes are the responsibility of the instructor. In the event of an accident, the Instructor is liable to cover any insurance costs, unless the pupil has intentionally damaged the instructor’s car, then that will be at the instructor’s discretion.

7. All special offers and course/lesson prices are subject to change without notice and are at the discretion of the company.

8. If a gift voucher is supplied by Bristol Intensives Ltd, then the voucher is valid for a maximum period of 6 months from the date of issue. Gift vouchers are to be used by the person, or persons named on the voucher and are non-transferable.

9. If payment is received by an instructor for a course of lessons and the pupil does not complete the course, then the remaining hours are valid for a period of 1 month if you have to reschedule some of the hours, at the instructor’s discretion. After this time, the lessons and test fees may be retained to cover services already provided and instructor time reserved that cannot reasonably be reallocated.

10. If you pass your practical driving test before all reserved course hours have been used and choose not to use the remaining tuition, any refund due will be calculated taking into account tuition already provided, instructor time specifically reserved, reasonable losses directly arising from cancellation of the remaining tuition and the extent to which the unused instructor time can reasonably be reallocated.

10. You must not be under the influence of drink or drugs at any time during your course. If we, or a representative of Bristol Intensives, suspect or detect any sign of this, the remainder of the course will be terminated and charges may apply for all instructor time reserved and services already provided.

12. You supply on the first lesson a signed provisional driving licence. If you fail to produce a valid provisional driving licence, the driving school/instructor cannot by law permit you to drive a car and accordingly your booking may be cancelled and charges may apply for instructor time reserved and administration already undertaken.
